APC Primary: Court Orders Fresh Elections in Some Wards of Jos South/Jos East Federal Constituency

The Federal High Court sitting in Jos has delivered judgment in a pre-election dispute between Hon. Esther Danboyi and Hon. Dachung Bagos, ordering fresh primary elections in the affected wards of Jos South/Jos East Federal Constituency.

In the suit instituted on behalf of Hon. Esther Danboyi by R. T. Yilwatda, Esq., of Gyang Zi, SAN & Co., the court dismissed the Notice of Preliminary Objection and counter-affidavits filed by the defendants, describing them as frivolous and unmeritorious.

The first defendant was represented by counsel, Niri Darong, while the All Progressives Congress (APC) was represented by A. O. Usman.

The court further held that the relevant provisions of the Constitution, the Electoral Act and the APC guidelines governing primary elections had not been complied with. Consequently, it found that the required elections had not been conducted in the wards complained of by the plaintiff.

Accordingly, the court ordered that elections be conducted in the affected wards within 30 days and awarded ₦500,000 in costs against each defendant, payable to the plaintiff.

The judgment underscores the importance of strict compliance with constitutional provisions, electoral laws and the guidelines of political parties in the conduct of primary elections.

Justice must not only be done; electoral processes must also comply with the law.
